Biography

Kieran advises clients on both commercial and individual legal matters. Whether the matter is heard in court or settles privately, he takes a pragmatic, but persistent approach to resolving or settling disputes. His litigation skills were honed while with a large downtown Vancouver firm, Bull Housser & Tupper LLP, and earlier with a New York City litigation firm.

Kieran gives employment advice to both employers and employee; working for both sides of the fence gives Kieran a unique and valuable perspective, allowing him to resolve disputes and anticipate litigation strategies. His employment practice includes litigating as well as providing advice on contracts, termination of employees, executive compensation, risk reduction, overtime averaging agreements, discipline, stock options, structured incentive plans, privacy issues, wrongful dismissal, human rights and more. His strong negotiation skills benefit his clients and often result in improving severance packages for employees, or reducing risk exposure and costs for employers.

Kieran is also a registered trade-mark agent. His practice is also focused on the protection of intellectual property and trade-marks, which includes assisting clients with trade-mark registrations and licensing, non-compete and confidentiality agreements, privacy issues and trade secrets. Kieran provides skilled advice regarding copyright issues.  He is intimately familiar with the advertising and media industries, and issues involving comparative advertising, defamation, and internet domain name disputes.

Kieran regularly deals with internet-related legal issues related to contracts, licensing and on-line enforcement.  He has worked for the music industry, artists, a global image database enterprise, as well as a variety of other notable clients.  This knowledge and experience enables him to advise on online reputation management of individuals and business, and to get negative comments or picture taken off the internet.

Kieran’s other area of interest is in estate disputes, adult guardianships, wills variation issues and dealing with both problematic executors and children or common law spouses wishing to challenge a will. He also assists clients with probate issues and executor’s accounts.  He also works on simple and complex personal injury and family law matters.

Before Kieran joined CBE, he gained a depth of skills and experience.   Kieran worked for Citizenship and Immigration Canada and with a litigation firm in New York City.  Kieran has a Bachelor of Arts with Distinction in Media Communications from Concordia University.  He received his Bachelor of Laws from the University of Victoria in 2005.  Kieran has worked for Citizenship and Immigration Canada and a medical malpractice litigation firm in New York City.  Kieran is avidly involved in media and the arts and maintains blogs on employment and intellectual property law.
